• The terms "we", "us", "our", "bank", "MCC" refer to Metrobank Card Corporation. "You", "Your" and "Yours" refer to any Metrobank Card Corporation credit card holder.

• The term "M Online Services" refers to the MCC website's (M Online) online facilities accessed through a user login. The user login credentials (ID and password) are acquired through registration that utilizes cardholder details for user authentication.
• 
  
• The M Online Services Terms and Conditions shall not in any way supersede the MCC Website's Privacy, Terms and Conditions and Terms of Use. Rather, the following paragraphs shall be a supplement to all those articles and its totality shall govern your use of the M Online Services pages. We recommend that you read all the articles mentioned above.

• Acceptance
1. By ticking on "I accept the Terms and Conditions" button and submitting this form, you confirm that you have read and understand that you are bound by the Terms and Conditions of the M Online Services including but not limited to the following paragraphs.
2. You likewise agree to be bound by any and all laws, rules, regulations and official issuances applicable to M Online Services, now existing or which may hereinafter be issued or communicated by MCC through whatever means, as well as such other terms and conditions governing the use of other facilities, benefits, or services which MCC may make available to you in connection with M Online Services, including the full provisions in the Privacy and Security document available in our website, the salient features of which are incorporated in this Terms and Conditions.
3. You also accept and agree to pay any applicable fees associated with the use of the same.


• Proprietary Interest
1. MCC is the sole owner of all the information and materials (including any enhancements or modifications) used in, or derived from, providing you with M Online Services (including, without limitation, all the facilities provided on its pages).
2. You recognize MCC�s proprietary interest in the M Online Services and agree that:
   • M Online Services and all its facilities shall be used only for their intended purposes. You shall not disassemble, decompile, copy, modify or reverse engineer any software or allow anyone else to do so.
   • Any information relating to the use of M Online Services, except those which are of public knowledge, shall not be disclosed to any other party.


• Disclosure
1. If MCC is served with a subpoena or other legal process in connection with your relationship with us which may require the disclosure of any information or material related/incidental thereto, MCC shall notify you thereof, and you shall cooperate in the implementation thereof, except if you are lawfully contesting the legality of the same.
2. In case MCC shall be required by any government agency to disclose your relationship with us, we shall notify you of such requirement on a best effort basis prior to any such disclosure.


• Privacy and Security
1. MCC maintains a policy of protecting your right to privacy regarding the collection and use of your personal information on the M Online Services pages. Our privacy policies apply to all users of the site. We safeguard all information that you may provide us and we do not collect personal information from anyone who is not logged in to M Online Services.
2. The M Online Services is served from a secure server. This means that each page you view and any information you submit is encrypted on its way between your computer and our servers. Even in the highly unlikely event that your transmission is intercepted, it will not be usable by anyone. Your peace of mind and the safeguarding of your information is a top priority for MCC. All internet related transactions are done through a 128-bit SSL. However, we do not warrant the security, secrecy or confidentiality of any information transmitted through any Internet service provider, network system or such other equivalent system in any jurisdiction if said transmission has indeed been intercepted and decrypted.
3. You are deemed to have sole access to your M Online Services login account.
4. You shall be responsible for keeping your login ID and Password confidential.
   • You shall not disclose your login ID and Password to any unauthorized person and shall take the necessary steps to prevent the discovery of your login ID and Password by any unauthorized person.
   • You shall also ensure that you sign-off from M Online Services whenever you have finished your sessions.
5. MCC may terminate your access to M Online Services should the wrong password to a login ID be used three (3) times. You may reset your password via answering correctly the website's Security Questions or through calling our 24/7 Customer Service Hotline. Security questions shall also be asked for the latter.
6. You shall notify MCC immediately upon receipt of any data or information through M Online Services, which is not intended for you and, when possible, shall delete such data or information from your terminal immediately. You shall ensure the strict confidentiality of such information.


• LIMIT ON LIABILITY
1. MCC reserves the right to determine the scope of the M Online Services, set or change the daily cut-off time, modify, restrict, withdraw, cancel, disconnect, deactivate, suspend or discontinue any or all services without prior notice to you.
2. MCC shall not be liable to you for your inability to use M Online Services or to access the any of its facilities, for any unauthorized actions or transactions using your login ID and Password, or for any other cause beyond our control, such as but not limited to, problems due to computer hardware or software (including viruses and bugs) or related/incidental problems that may be attributed to the services provided by any service provider or information service provider.
3. You shall provide MCC with a correct and operational e-mail address. MCC shall not be liable for any undelivered e- mail communication or any cost that you may incur for maintaining an Internet access and an e-mail account.
4. You shall promptly notify MCC of any change in your e-mail address, contact numbers, home or business address or any other information which may affect communication.
5. MCC shall not be liable for any loss or damage in connection with any unauthorized interception or use of data relating to you or to your account(s), including the missending thereof.
6. You authorize MCC to act upon any instruction, which is identified by the use of your login ID and Password. MCC shall be responsible for acting only on those instructions sent through the M Online Services, which are actually received and you agree that we do not assume any responsibility for malfunctions in communications facilities not under our control that may affect the timeliness or accuracy of the instructions sent.
7. Upon our receipt of your instruction(s), we may implement them at our absolute discretion. MCC shall be entitled to treat and consider as valid and binding on you any instruction given or agreement made with us, through the internet by any person using your login ID and Password, including without limitation, any transactional service offered by M Online Service. MCC shall neither be liable for such instructions nor be obliged to investigate the authenticity or authority of the persons sending your instructions nor verify the accuracy and completeness of your instructions. Such instructions shall be deemed correct, complete, irrevocable, and binding upon you upon our receipt thereof. You hereby accept full responsibility for all transactions executed via the M Online Services and in particular, in ensuring the accuracy and completeness of your instructions.
8. MCC shall be entitled but not obliged to verify any instructions given through the use of your login ID and Password by sending e-mail online or via telephone or any other means.
9. You agree that MCC may, without notice and without stating the reason therefore, cancel or refuse to execute any of your instructions at any time without incurring any liability.
10. MCC shall not be liable for any and all liability(ies), claim(s), suit(s), damage(s), expense(s), and/or any other cost(s) that may arise by making available to you your statement(s) of account, such as but not limited to erroneous statement(s) of account and access to a statement(s) of account intended for a different person(s). You agree to bring up any such omission(s)/error(s) with MCC.
11. You shall be solely liable for any losses or damages that you may incur:
    • for any discrepancies, omissions, inaccuracies or incorrect entries in our statement that you did not immediately report to us;
    • if you acted fraudulently or negligently, including failing to properly safeguard your login ID and Password;
    • if you failed to immediately report any unauthorized transaction(s) made in your M Online Services account;
    • if for some reason and without fault on our part, your bill for any M Online Service facility (whenever applicable) remains unpaid and the biller discontinues/cancels your coverage;
    • if your instruction is not implemented and you fail to promptly report it to us.
12. MCC reserves the right to deactivate you from M Online Services without prior notice due to mishandling of accounts as defined by the standard operating procedures or, if in our judgment, your continued access to M Online Services may adversely affect the credibility/security of the system. While such deactivation may be temporary, MCC reserves the right to permanently delist you from M Online Services.


• SHARING OF INFORMATION
1. To avail of the full benefits of the M Online Services and to enjoy the whole spectrum of services from MCC that you may wish to avail of, you authorize us to share information regarding your personal circumstances with our subsidiaries, affiliates, representative offices, agents or other authorized third parties we may select.
2. You shall notify MCC in writing, which must be duly acknowledged by us, if you do not wish the information regarding your personal circumstances to be shared with our subsidiaries, affiliates, representative offices, agents, or other authorized third parties we may select.


• AMENDMENT
MCC may amend/supplement this Agreement from time to time without prior notice to you.


• TERMINATION
MCC may terminate this agreement once your M Online Services account is closed, dormant, garnished, escheated, or for whatever reason, without the need of prior notice to you.


• M In Control
1. You acknowledge that M In Control is a facility granted by MCC through the M Online Services which you may avail of for as long as it is offered by us, and provided that you continue to be qualified under the terms and conditions.
2. You also acknowledge that while M In Control is available 24 hours a day, some or all of the services may not be available at certain times due to maintenance, computer, telecommunication, electrical, or network failure and/or any other reasons beyond MCC�s control.
3. You understand that only principal cardholders can enroll, view and edit control profiles in M In Control.
4. You further understand that MCC MasterCard products are enrolled to M In Control separately.
5. You accept that a monthly subscription fee of P70.00 shall be charged to your credit card account enrolled in M In Control, and that;
6. The subscription fee is billed per principal card account enrolled in M In Control.
7. You shall ensure that your mobile phone service provider supports SMS, that your mobile phone is capable of receiving SMS and that your email address is correct and operational. MCC shall not be liable if you do not receive SMS or email notification/s due to the failure of your mobile or email service provider/mobile phone or due to incorrect or non-operational email address.
